TCG Collectors Day

These Terms & Conditions apply to all visitors, ticket buyers and vendors attending or participating in an event organised by TCG Collectors Day. By purchasing a ticket, booking a vendor table or attending the event, the applicable Terms & Conditions below are accepted.

Terms for Visitors

1. Agreement with the Organiser

As the buyer of a ticket or product (the “Buyer”), you enter into an agreement with the organiser of the event (the “Organiser”).

The Organiser is responsible for the organisation and delivery of the event and its related services.

WeTicket provides the ticketing platform but is not a party to the agreement between the Buyer and the Organiser. WeTicket is not responsible for the organisation, cancellation, rescheduling or modification of the event.

2. Ticket Purchases and Refunds

All ticket purchases are final.

If a Buyer is unable or chooses not to attend the event for personal reasons, including illness, travel issues or changes in personal circumstances, no refund will be issued.

Tickets may be transferred or resold to another person. The Buyer remains responsible for ensuring that the ticket and corresponding QR code are only provided to the intended new ticket holder.

Each ticket is valid for one admission only. Once a ticket or QR code has been scanned and accepted at the entrance, it cannot be used again.

Copied, duplicated, manipulated or fraudulent tickets may be refused.

The Organiser reserves the right to refuse admission where ticket fraud or misuse is reasonably suspected.

3. Rescheduling of the Event

The Organiser reserves the right to reschedule the event when circumstances reasonably require this.

If the event is moved to another date, purchased tickets will automatically remain valid for the rescheduled date.

If the Buyer is unable to attend the rescheduled date, the Organiser may offer the possibility to transfer the value of the ticket to a future edition of TCG Collectors Day.

No cash refund will normally be issued in the event of rescheduling, except where a refund is required under applicable law.

The Organiser will communicate the applicable procedure and any relevant deadlines to ticket holders in the event of a rescheduling.

4. Cancellation of the Event

If an event is completely cancelled and no replacement date is offered, the Organiser will communicate the applicable compensation or refund procedure to ticket holders.

Any refunds or other remedies will be handled in accordance with applicable law.

The Organiser is not responsible for additional costs incurred by visitors in connection with attending the event, such as transportation, accommodation, parking or other personal expenses, except where liability cannot legally be excluded.

5. Changes to the Event

The Organiser reserves the right to make reasonable changes to the programme, vendors, partners, activities, opening hours, floor plan, services or other content of the event.

Such changes do not automatically entitle the Buyer to a refund.

The Organiser may deviate from this policy where appropriate and will communicate significant changes where reasonably possible.

6. Admission, Behaviour and Safety

All visitors must follow the instructions of the Organiser, event staff, venue personnel and security personnel.

The Organiser reserves the right to refuse admission to or remove any person from the event where there is a reasonable suspicion of or involvement in:

  • theft or attempted theft;
  • fraud, scams or deceptive practices;
  • aggression, threats, intimidation or harassment;
  • violence or attempted violence;
  • vandalism or intentional damage;
  • dangerous or seriously disruptive behaviour;
  • ticket fraud;
  • failure to follow reasonable safety or security instructions;
  • other unlawful conduct.

A person who is refused admission or removed from the event due to such behaviour is not entitled to a refund.

Where theft, fraud, aggression, violence or other unlawful behaviour is suspected, the Organiser may involve venue security and/or the police and may provide relevant information or evidence to the competent authorities where legally permitted or required.

Further legal action may be taken where appropriate.

7. Photography and Video Recording

Photographs and video recordings may be made during TCG Collectors Day for reporting, communication, promotional and marketing purposes.

These images and recordings may be used on the Organiser’s website, social media channels, advertisements and other promotional materials relating to TCG Collectors Day and future editions.

Visitors acknowledge that general crowd, atmosphere and event footage may include them incidentally.

Where an individual is specifically featured or portrayed as the main subject of promotional content, the Organiser will seek appropriate consent where required by applicable law.

Additional care will be taken when minors are specifically portrayed.

Visitors who have concerns about the use of an image in which they are clearly identifiable may contact the Organiser. The Organiser will assess such requests and take reasonable measures where appropriate.

8. Personal Belongings, Cards and Valuables

Visitors are responsible for their own belongings at all times. This includes, but is not limited to:

  • trading cards;
  • sealed products;
  • cash;
  • smartphones and electronic devices;
  • bags and clothing;
  • collectibles;
  • other personal or valuable property.

The Organiser is not responsible for loss, theft or damage to personal belongings, except where liability cannot legally be excluded.

Visitors are strongly advised to supervise valuable cards, products, cash and other belongings at all times.

9. Privacy and Personal Data

Personal data collected in connection with ticket purchases may be processed by the Organiser and/or its ticketing provider for purposes including ticket administration, event organisation, customer communication, security and compliance with legal obligations.

Where WeTicket processes personal data, its own privacy policy applies to that processing.

Marketing communications will only be sent where there is an appropriate legal basis for doing so.

Terms for Vendors

10. Vendor Bookings and Non-Refundable Table Fees

All vendor table bookings are final.

Once a vendor table has been booked and payment has been made, the table fee is non-refundable if the Vendor is unable or chooses not to attend the event.

This applies regardless of the Vendor’s personal reason for cancellation or absence.

The Vendor may arrange for another Vendor to take over the table in accordance with Article 11.

11. Transfer or Resale of Vendor Tables

If a Vendor is unable to attend, the Vendor may transfer or resell the booked table to another Vendor.

The original Vendor must inform the Organiser immediately when such a transfer is arranged.

The Organiser must receive the relevant details of the replacement Vendor, including:

  • name;
  • contact details;
  • TCG/business name or brand, where applicable;
  • any other information reasonably required for the event administration.

The Organiser will use this information to update the registration and, where necessary, the floor plan.

A transfer does not entitle the original Vendor to a refund from the Organiser. Any payment arrangements between the original Vendor and replacement Vendor are their own responsibility.

12. Vendor Products, Sales and Authenticity

Vendors are solely responsible for the products and services they offer or sell during the event. This includes responsibility for:

  • authenticity;
  • legality;
  • condition;
  • description;
  • pricing;
  • applicable taxes;
  • compliance with applicable consumer and commercial laws.

The sale, display or intentional distribution of counterfeit or fraudulent products is prohibited.

The Organiser is not a party to transactions between Vendors and visitors and is not responsible for disputes concerning purchases, trades, prices, authenticity, condition or other aspects of transactions between third parties, except where liability cannot legally be excluded.

If the Organiser reasonably suspects that a Vendor is knowingly selling counterfeit products, committing fraud or engaging in other unlawful conduct, the Organiser may require the Vendor to stop the relevant activity and may remove the Vendor from the event without refund. Security and/or police may be involved where appropriate.

13. Vendor Space and Event Rules

Vendors may only use the table and space assigned to them by the Organiser.

Vendors may not occupy additional tables, neighbouring vendor areas, walkways, emergency exits or other event spaces without permission from the Organiser.

Walkways, emergency routes and exits must remain clear at all times.

Vendors must follow reasonable instructions from the Organiser, venue personnel and security personnel relating to safety, logistics and event operations.

Vendors are responsible for their own:

  • cards and products;
  • inventory;
  • cash;
  • equipment;
  • displays;
  • electronic devices;
  • personal belongings.

The Organiser is not responsible for theft, loss or damage to Vendor inventory, products or other belongings, except where liability cannot legally be excluded.

Dangerous equipment, installations or materials may not be brought into or used at the event without the Organiser’s prior permission.

Vendors are responsible for leaving their assigned area in a clean and orderly condition.

14. Removal of Vendors

The Organiser reserves the right to remove a Vendor from the event where the Vendor seriously violates these Terms & Conditions, applicable law, venue rules or reasonable instructions from the Organiser or security personnel.

This includes, but is not limited to, fraud, knowingly selling counterfeit products, theft, aggression, harassment, dangerous behaviour or intentionally disrupting the event.

Removal for such reasons does not entitle the Vendor to a refund of table fees or other costs.

General Provisions

15. Force Majeure

The Organiser shall not be responsible for a failure, delay, modification, rescheduling or cancellation caused by circumstances outside the Organiser’s reasonable control. Such circumstances may include, but are not limited to:

  • fire;
  • extreme weather;
  • natural disasters;
  • government measures or restrictions;
  • serious safety or security incidents;
  • failure or unavailability of essential infrastructure;
  • serious technical failures;
  • circumstances affecting the availability or safe operation of the venue;
  • strikes or other major disruptions;
  • other circumstances that could not reasonably have been prevented or controlled by the Organiser.

In such circumstances, the Organiser may take reasonable measures including changing the event, changing opening hours, rescheduling the event or, where necessary, cancelling the event.

Where an event is rescheduled, Article 3 applies. Where an event is cancelled entirely, Article 4 applies.

Nothing in this Article limits rights that cannot legally be excluded under applicable law.

16. Liability

The Organiser will take reasonable measures to provide a safe and properly organised event.

To the extent permitted by applicable law, the Organiser is not liable for indirect losses or for loss, theft or damage caused by third parties, Vendors, visitors or circumstances outside the Organiser’s reasonable control.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

17. Applicability and Updates

These Terms & Conditions apply to TCG Collectors Day events unless specific additional conditions are communicated for a particular event.

The Organiser may update these Terms & Conditions from time to time. The version applicable to a purchase or booking is the version made available at the time the relevant ticket or Vendor table is purchased, unless mandatory law requires otherwise.

18. Governing Law

These Terms & Conditions are governed by Belgian law.

Any dispute shall be handled by the competent courts in accordance with applicable Belgian law, without prejudice to mandatory consumer protection rules concerning jurisdiction.
